T1 - Remote Litigation in the Kingdom of Saudi Arabia

N2 - In the current era of technology and artificial intelligence (AI), remote litigations are equivalent to online dispute resolution (ODR) platforms, which work by digitizing disputes and provide a communication platform for parties of either side to resolve their dispute. This paper examines the growth of remote litigation in the Saudi Arabian legal system. To determine the effectiveness of remote litigation, an inductive analytical approach was adopted in a qualitative research design. The data was collected through literature survey, documentation study and readings of Acts and regulations. The results revealed that remote litigation ensures a swift case resolution, enabling litigants to achieve timely justice. It was also found that the Saudi Arabia has coordinated its technological, organizational, administrative, and human resources to produce the desired results. The most significant technical challenges litigants encounter in remote litigation include information and communication illiteracy, insufficient internet infrastructure, the growth of computer piracy, the spread of viruses, and a lack of confidence. The study also covers many laws passed to bring about important technical changes in the legal system. Finally, the study offers a few recommendations that include the total automation of judicial institutions and the connection of all pertinent authorities through a secure and exclusive network that enables the seamless performance of litigation procedures.
